Welcome to Vidsam Productions. By booking our services, using our website, or engaging with us in any capacity, you agree to the following Terms of Service. Please read them carefully.
1. Services
Vidsam Productions provides professional photography, videography, and related media production services. The specific deliverables, timelines, and pricing for each engagement are outlined in the booking confirmation or separate written agreement provided to the client.
2. Bookings & Payments
- A non-refundable deposit (typically 30–50% of the total fee) is required to secure your booking date. The remaining balance is due on or before the day of the event unless otherwise agreed in writing.
- Bookings are only confirmed upon receipt of the deposit and a signed booking form or email confirmation from Vidsam Productions.
- Prices are quoted in Kenyan Shillings (KES) unless otherwise stated.
3. Cancellations & Rescheduling
- Client cancellations: Deposits are non-refundable. If you cancel within 14 days of the event, the full contracted fee may be due.
- Rescheduling: Requests to reschedule must be made at least 7 days in advance and are subject to availability. One reschedule is permitted at no extra charge; subsequent changes may incur an administrative fee.
- Cancellation by Vidsam Productions: In the unlikely event that we must cancel due to circumstances beyond our control (illness, equipment failure, natural disaster), we will issue a full refund of all amounts paid or assist in finding a suitable replacement photographer/videographer.
4. Delivery of Work
- Edited photos and videos are delivered within the timeframe specified in your booking agreement (typically 2–6 weeks after the event).
- Deliverables are provided via digital download or an agreed delivery method. Physical prints or albums are subject to separate pricing.
- Vidsam Productions makes every effort to deliver high-quality work; however, we cannot guarantee specific results in adverse weather, poor lighting, or other uncontrollable conditions.
5. Copyright & Usage Rights
Vidsam Productions retains full copyright of all photographs and videos produced. Clients are granted a non-exclusive, non-transferable personal licence to use the delivered media for personal purposes (social media, printing for personal use, etc.).
Commercial use, resale, or licensing of our work to third parties requires written permission from Vidsam Productions and may be subject to additional licensing fees.
We reserve the right to use images and footage from any shoot in our portfolio, website, and marketing materials unless the client requests otherwise in writing before the event.
6. Client Responsibilities
- Clients are responsible for ensuring access to the venue and notifying relevant parties of our presence.
- Clients must inform us of any specific requests, shot lists, or restrictions (e.g., no-photography zones) before the event.
- Vidsam Productions is not liable for missed shots resulting from restricted access, uncooperative guests, or failure to communicate requirements in advance.
7. Limitation of Liability
In the event of equipment failure, data corruption, or any other circumstance that results in partial or total loss of media, Vidsam Productions' liability is limited to a refund of amounts paid. We strongly recommend clients do not delete any raw footage or behind-the-scenes captures until final deliverables are confirmed.
8. Governing Law
These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes shall be resolved through negotiation in good faith, or, if necessary, through the appropriate Kenyan courts.
9. Changes to These Terms
We may update these Terms of Service from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
